Though accepted in international law, the concept of "joint development" has been variously defined. This paper holds that "joint development" should be defined in the narrower sense of the term, on both legal and functional dimensions, thus: Joint development is an activity of prospecting, development or exploitation of deposits, conducted by the sovereign states according to agreements in a certain mode of cooperation over an area straddling across the boundaries of adjacent countries or an area under dispute....

This paper holds that "joint development" should be defined in the narrower sense of the term, on both legal and functional dimensions, thus: Joint development is an activity of prospecting, development or exploitation of deposits, conducted by the sovereign states according to agreements in a certain mode of cooperation over an area straddling across the boundaries of adjacent countries or an area under dispute. Joint development is therefore typically an optional alternative, adopted by concerned entities which are the states, for sharing deposits common to them, for functional purposes and on an interim basis.

The demarcation in the East China Sea has become one of the focuses of the Sino-Japanese contradiction,and the reason of which is that both sides have different standards.The fair principle is the general principle of the international law,while the equidistant medium line principle is the special case of the fair principle.The special geographical state of the East China Sea's continental shelf and the existence of the sea trough of Okinawa decide that both sides should fairly demarcate on the basis of natural extension.Proportional principle is also an important factor reflecting the fair principle.Undeniably the equidistant medium line principle is applicable in some sea areas.Negotiation or submitting it to the International Court is among the ideal solutions to eliminate the contradiction as early as possible.Suspending dispute and developing together have the directive significance in solving the current problem.

东海划界是中日矛盾焦点之一,其原因是双方划界的标准不一。公平原则是国际法的一般原则,等距离中间线原则是公平原则的一种特例。东海大陆架的特殊地理状况和冲绳海槽的存在确定了双方应按照以自然延伸为基础的公平原则划界。成比例原则也是体现公平原则的一个重要因素,不可否认在部分海域有适用等距离中间线原则的可能。通过协商谈判或提交国际法院裁判等渠道尽早划界是解决矛盾的理想办法。共同开发是当前解决争执的最佳过渡安排。

At present,China's marine security situation is grim with its maritime interests and rights being severely infringed upon.China's maritime security mainly refers to the security in the sea areas under its jurisdiction,which requires first of all clear and definite maritime boundary lines.The delimitation of maritime boundary lines needs the settlement of islands sovereignty disputes and of EEZ(exclusive economic zone) and continental shelf delimitation disputes.Usually there are three approaches to achieve a fair and equitable solution: through negotiation and mutual compromise among related parties;through the adjudication by the International Court of Justice(ICJ) and the arbitration or mediation of a third-party;by shelving the disputes for a period and working for joint development or joint jurisdiction among relevant parties in the disputed areas.In my view,the settlement of China's maritime jurisdictional disputes could be dealt with in accordance with the above three approaches.

当今,我国海洋安全形势严峻,海洋权益受到严重侵犯。所谓海洋安全主要是指海洋管辖区的安全;这就首先要明确海疆线。划定海疆线就要解决与相邻和相向国家间的岛屿归属争议及大陆架和专属经济区的划界争议。国际上通常有三种途径来实现公正解决:有关方面通过谈判和相互让步实现解决;通过国际法院的裁决及第三者的仲裁和调停实现解决;搁置争议,共同开发或共同管辖。我认为,中国可参照国际上解决管辖争议的上述三种途径,来解决其海洋管辖争议。
