The method has irreplaceable advantage in developing students' ability of applying law, incenting students' activity, cultivating students' creative thinking and ability to solve problem . It's necessary to focus on the four stage: choosing suitable ease, previewing, discussing and summarizing if you want to make the method take effete in teaching.

法学案例教学法是将学生置身于真实法律环境中,让学生自主分析和研究案例,释解成文法内容并培养学生实际应用能力的教学方法。此教学法在培养学生法律应用能力、调动学生学习的积极性和主动性,培养学生的创造性思维和解决问题的能力方面具有不可替代的优点。在法学专业教学中让案例教学法真正发挥其效果,必须抓住案例的选择、学生课前预习、课堂讨论、讨论后的总结四个环节。

In this paper,the case,legal regulation,problems concerning law and law education,which are the prerequisite in the teaching of the case,are regulated analyzed in an attempt to indicated the role of teaching of case.Due to the contradictions between abstract rule and concrete case,following the rule and researching the rule,academic law education and professional law education,teaching and studying,teaching of case in law science should be a starting point,a contrast,a medium connecting theory and practice rather than an explanation,an example or an auxiliary measure.

试图通过对法学案例教学法的前提问题,如案例,法律规则,法律问题,法学教育等问题进行清理和分析,而达到一个对法学案例教学法的合适的定位。由于抽象规则与具体案例间的矛盾,对规则的遵循与对规则的追问之间的矛盾,法学学术教育与职业教育间的矛盾,以及教学的主体与客体间的矛盾等等,法学案例教学法不应当是一个解释,一个例证,一个辅助工具,而应当是一个起点,一个对照,一个理论与实践之间的媒介。

案例教学法是法学课程教育中普遍推崇和倡导的教学方法,适合教学对象成人化、教学内容应用化、教学目的功能化、教学形式开放化等教学规律的要求。然而,国内法学案例教学远未发挥其应有的功能,距离法学理论教学目的要求也相差甚远。本文就法学案例教学法的意义与局限、设计与运用等方面做了初步探讨。
