The leasehold of real estate possesses the essential features of real right. Contract of Leasehold of real estate is basically different from leasehold of real estate. The leasehold of real estate is the usufruct and special real right in China. A study of the nature of the leasehold of real estate and its application mainly focuses on distinguishing it form creditor's right.

The right of allusion quotation is the unique traditional civil legal system of our country. Using the modern law science theory to define the nature of the right of allusion quotation, there are mainly three kinds of views: usufruct theory; the right of pledge theory and special real right theory. The usufruct theory is the most prevalent theory. All the three views, however, cannot give logical explanation to the nature of the right of allusion quotation. In the author's opinion, the quotation right is not a single right shape, it is a complicated civil trade way that combines real rights and creditor's rights. It is a mutation of the buying and selling telethon.

 典权是我国所独有的传统民事法律制度。运用现代法学理论对典权的性质进行界定,主要有三种观点;用益物权说、担保物权说和特种物权说,其中用益物权说比较通用。上述三种观点均不能对典权的性质作出恰当的解释。所谓的典权实非单一的权利形态,是一种融物权、债权关系为一体的复杂民事交易方式,应为买卖关系的变种。

信托受益权性质一直存在争议,归纳起来有债权说、复合权利说、新权利说等不同观点。上述学说虽然有一定的合理性,但都存在可商榷之处。从实然层面和应然层面分析,信托受益权应定位于物权。信托受益权标的物的不特定性与受益人给付请求权存在的事实不能作为否认信托受益权为物权的当然理由,而且作为一种特殊物权,信托受益权并不违反物权法定原则和一物一权主义。
