As concept of law, national education includes not only education for minority people, but education carried out in minority areas. The characteristics of national education has decided the necessity and emergency of national educational legislation. Before liberation, China already had national educational legislation, but it developed very slowly. After liberation, national educational legislation has gone through three phases and has made great achievements, but it still has the problems such as: imperfect system, no distinguishing traits, poor legislative technique, unscientific legal mechanism and backward theoretical research. National educational legislation should insist the following three basic principles: to ensure the right of education for minority nationalities, to take national traits and regional characteristics into full consideration and to insist separation of religion from education for minority nationalities.

作为法概念的民族教育不仅包括对少数民族成员所实施的教育 ,还包括在少数民族地区所实施的教育。民族教育的特点决定了民族教育立法的必要性和紧迫性。旧中国也有民族教育立法 ,但发展缓慢。新中国民族教育立法大致可分为三个分阶段 ,成绩显著 ,但也存在着体系不完备、特色不鲜明、立法技术差、法律机制不科学、理论研究滞后等问题。民族教育立法应当坚持保障少数民族教育权实现、充分考虑民族特点和地区特点、坚持民族教育与宗教相分离三大基本原则

Right to education of minority nationalities is right of development of citizens ensured by constitution and laws. How to accomplish the equality of right to education of minority nationalities influences not only the development of minority nationalities but also the advancement of the state and the society. After the founding of new China, although our education for minorities has made great achievements and the right to education of minorities has developed greatly, we should notice that in some fields and some aspects right to education of minority nationalities can not be fully ensured. How to effectively accomplish right to education and how to ensure right to education deserve exploitation and consideration. On the basis of the actual situation of right to education of minority nationalities, the author affords his own opinions and thoughts on how to ensure the achievement of right to education.

少数民族受教育权是宪法和法律保障的公民的发展权。如何实现少数民族受教育权的平等 ,不但影响到少数民族自身的发展 ,也关系着国家和社会的进步。建国 50多年来 ,虽然我国的民族教育事业取得了巨大成就 ,少数民族受教育权获得长足发展 ,但同时应当看到 ,在某些领域、某些方面 ,少数民族受教育权还不能完全实现。如何充分有效实现受教育权、保障受教育权 ,值得探索、思考。本文作者针对少数民族受教育权现实状况以及如何保障受教育权实现进行分析、提出了自己的观点、看法 ,以期共鸣。

The educational conditions of the minority nationality have got great achievements since the foundation of the People's Republic of China. It has contributed greatly to our socialist revolution and construction. While, compared with the east advanced areas of China, the educational conditions of the minority nationality areas are backward for the reasons of history, geography, economy, religion ... ... and etc. This kind of condition can not meet the requirements for qualified personnel and the level of competence...

The educational conditions of the minority nationality have got great achievements since the foundation of the People's Republic of China. It has contributed greatly to our socialist revolution and construction. While, compared with the east advanced areas of China, the educational conditions of the minority nationality areas are backward for the reasons of history, geography, economy, religion ... ... and etc. This kind of condition can not meet the requirements for qualified personnel and the level of competence of the laborers of the social and economic development of the minority nationality. Thus, the article starts with the present educational conditions of the minority nationality of our country. It also analyzes the necessity and the foundation of the educational legislation of the minority nationality. It also states the basic principles which should be followed of the educational legislation of minority nationality and the concrete contents of the legislation.

建国以来 ,我国少数民族教育取得了可喜成绩 ,为我国社会主义革命和建设事业做出了很大的贡献。但是 ,由于历史、地理、经济、宗教等因素的影响 ,我国少数民族教育与东部发达地区相比 ,还相对落后 ,远远满足不了少数民族自身经济社会发展对人才和劳动者素质的要求。因此 ,本文从我国少数民族教育发展现状入手 ,阐述了我国少数民族教育立法的必要性和立法依据 ,提出了少数民族教育立法应遵循的基本原则及具体的立法内容。
