How administrative licensing system reforms stick to market orientation and thereby radically break through present system, is one of great directional problems of reforming our administrative licensing system and enacting Administrative Licensing Act. The article attempts to present constructive scheme and new ideas of establishing our new administrative licensing system. The article discusses the values and its legal problems of notice-acceptance model probed by Pudong, Shanghai, points out and demonstrates that licensing by one authority is a ultimate solution of solving present many-authorities-licensing questions, also analyzes other innovating measures of setting up office of public services, carrying out ex post facto licensing, processing licensing by network,adopting implied licensing, etc.

The reform of administrative licensing in Chinese economic field is closely related to the establishment of socialism market economy and participation into the competition in the WTO system. Chinese administrative licensing system must meet the requirement of market economy and obey the rules of international fair competition. Since administrative licensing has been transformed from administrational means in the planned economy into the regulational means in the marked economy, responding to the WTO regulations, Chinese economic law must assume its regulation、 transformation and normalization. To construct a new economic system of administrative licensing, much attention must be attached to the special role of WTO regulations and Chinese economic law. Thus, WTO regulations correspond to the Chinese economic law in function, content and legal efficacy.

中国经济领域的行政许可制度改革与社会主义市场经济体制的建立和参与 WTO体制下的竞争密切相关。WTO规则要求中国的行政许可必需符合市场经济的要求和国际公平竞争规则 ,并为行政许可留下空间。而将行政许可由计划经济的行政手段转化为市场经济中的国家调控手段、回应 WTO规则 ,中国经济法承担调整、转化和规范许可行为的任务。构建新型的经济行政许可制度 ,必须充分重视 WTO规则和中国经济法的特定作用。由此可见 ,WTO规则与中国经济法在功能、具体内容和法律效力等方面均存在契合性。
